Step 1

Receiving Applications - Sales Department

1st day

- Receive and check documents; Check legal documents related to auctioned assets, request customers to supplement documents (if any)

-  Inform customers of the auction organization process, organization time, payment, auction service remuneration, etc.

-  Send the Property Auction Contract sample for customers' reference.

- Prepare document receipts.

Step 2

Actual Survey - Sales Department

2nd day

- Take photos of auctioned properties

- Prepare an actual survey to record the condition of the property

- Check the customer's right to sell assets.

- Survey the current situation and determine where the property is located.

- Receive property handover.

- Planning auctions and consulting for property owners.

Step 3

Contracting - Sales Department

- Drafting Contracts for submission to the Board of Directors

- Send the Contract to customers for reference.

- Editing and supplementing the Contract (if any)

- Get the Contract number, draft the Asset Auction Service Contract, and send it to the Asset Owner.

- Submit to the Board of Directors, both parties sign the contract, the contract is made in 04 copies, and each party keeps 02 copies.

- Promulgating Auction Regulations.

Step 4

Post property information to newspaper and radio -Auction Secretary, Department of Operations

from 2nd day to 4th day

- After agreeing with the person who owns the property, post it on central or local press media, post 2 installments, each installment at least 02 business days apart (according to Article 57 of Law No. 01/2016/QH14 )

- Or posted on television stations twice, Song Pha auction company will carry out the execution.

Step 5

Drafting asset auction announcements and submitting them to the Board of Directors for approval - Auction Secretary, Department of Operations

Posting notice of property auction -Auction Secretary, Department of Operations

  • Announce and post:

- At the company (or its branch)

- At the location of the assets

- At the place where auctioned assets are being preserved and managed (for movable assets)

- At the People's Committee of the commune, ward or town where the real estate is auctioned

Step 7

Receive customers who buy auction documents - Auction Secretary, Department of Operations

from 15th day to 19th day

- Escort customers to view properties and view property records.

- Sell ​​documents, and register to participate in the auction.

 Auction documents package, including:

* Registration form to buy auctioned property.

* Regulations on property auctions

* Photocopies of documents related to the auctioned property

‚ Coordinate with the Accounting Department to collect auction participation fees for customers

Step 8

Receive customers to register to participate in the auction -Auction Secretary, Department of Operations

- Prepare a list of customers registering for the auction and submit it to the Director.

 The documents submitted by customers participating in the auction are:

* Registration form to buy auctioned property

* Certified copy of ID, family registration, or photocopies compared with the original

*  Certified copy of Business Registration Certificate (organization)

* Proof of deposit

‚ Coordinate with the Accounting Department to collect customer deposits (all will be paid via Bank account).

ƒ In case the customer places a cash deposit, the Accounting Department will transfer it to the Bank Account no later than 02 business days and summarize it the day before the auction.

Step 9

Report on auction registration status -Auction Secretary, Department of Operations

- After the end of the registration period to participate in the asset auction, summarize the situation and finalize the list of customers registered to participate in the auction.

- Submit to the Board of Directors about organizing the auction.

- Decide to assign an Auctioneer to run the auction and submit it to the Director.

- Prepare and send invitations, and prepare tools and equipment to organize the auction.

Step 10

Send an invitation to attend the auction -Auction Secretary, Department of Operations

19th day

- Property owner.

- Customers registering to participate in the assessment (for valid applications)

- In case there are no customers registered to participate in the appraisal, send an Official Notification to the Property Owner

Step 11

Organize an auction -Auction Secretary, Auctioneer, Department of Operations,  Accounting Department, and Board of Directors 

from the 20th day to the 22nd day

- Coordinate with the Administration Department to prepare tools, arrange conference rooms, etc.

- Conduct an auction.

- The auctioneer runs the auction (the Secretary attaches the Auction Minutes)

- Review auction results and prepare a document announcing the auction results.

- Sign the Asset Sales Contract (signed between the Auction Organization and the winning bidder) and submit it to the Director for approval

- Notarized at auction Asset Sales Contract (if real estate and required, not required by law).

- After the auction, coordinate with the Accounting Department to return the deposit to those who do not win the auction, and instruct the winning auction to pay the remaining amount (minus the reservation amount).

Step 12

Works after the auction are completed - Auction Secretary, Auctioneer, Department of Operations,  Accounting Department

from the 21st day up to the completion of Liquidation 

- Monitor payment deadlines for property purchases

  After the customer has paid in full to buy the property:

* Transfer the amount as specified in the Contract to the Property Owner.

* Notify the Property Owner to hand over the property to the buyer.

* Attend property handover with the Property Owner and the property buyer.

Step 13

Liquidation, transfer to Finance Department for implementation - Auction Secretary, Department of Operations

- Pay the amount according to the Contract Liquidation Minutes

- Issue value-added service invoices to the party whose assets are being auctioned

- Records.

- In case the auction is unsuccessful, send a written notification and request to continue signing the Contract Appendix with the auction organizing company, and the auction organization process will be repeated.
